Six soldiers reinstated after 3 years of fighting unceremonious dismissal

The High Court has reinstated six soldiers who had been discharged from the Zimbabwe National Army (ZNA) in February 2019.

The six were accused of theft of state property before being acquitted by a court-martial.

Justice Webster Chinamora reinstated Collen Chiba, Charles Mhuri, Bothwell Gorekore, Hillary Mubariki, Democracy Murambadoro and Gibson Madzinga.

Commander of the Zimbabwe Defence Forces and Minister of Defence were cited as respondents.

The six soldiers were charged in terms of the Defence Act with theft of state property and were acquitted before a court martial.

The applicants argued that they were not accorded the opportunity to give evidence or cross examine witnesses and interrogate documents relied on by the Board.

Justice Chinamora ruled in favour of the applicants and the respondents were ordered to pay costs of suit.

“The applicants be and are hereby reinstated to their positions without loss of benefits. The respondents shall pay costs of suit, jointly and severally, the one paying the other to be absolved,” ruled Justice Chinamora.
