The National Prosecuting Authority of Zimbabwe (NPAZ) has declined to prosecute broadcaster Owen Madondo, known as DJ Ollah 7, in a cyberbullying case involving musician and entrepreneur Mudiwa Hood.
The case stemmed from comments made by rapper Mukudzei Chatsama, popularly known as Holy Ten, during an interview on Madondo’s podcast. Hood had alleged that the remarks caused him distress and humiliation, leading to the case being referred for prosecution.
However, after reviewing the matter, the NPAZ determined that Madondo, as the podcast host, did not have the intent to harass or bully Hood, since the statements were made by his guest during a live broadcast. Consequently, the state found no grounds to pursue charges against him.
“While the complainant expressed a wish not to pursue the matter further, the Prosecutor General has the final authority in deciding whether charges are withdrawn, in accordance with NPAZ Prosecutorial Guidelines,” NPA said in a statement. “Victims of crime or complainants do not have the power to end criminal court processes-this decision rests with the Prosecutor General.”
With the state’s decision to decline prosecution, the case against DJ Ollah 7 is now effectively closed.
