High Court Judge Justice Rogers Manyangadze on Friday dismissed Job Sikhala’a appeal against magistrate Manuwere’s ruling on his bail application on changed circumstances for obstruction of justice.
Sikhala was appealing against the refusal of bail application on changed circumstances by magistrate Taurai Manuwere on 19 October.
His lawyer, Jeremiah Bhamu, who is instructed by the Zimbabwe Lawyers for Human Rights, had argued that Mawere misdirected himself.
“The continued denial of bail for Sikhala has actually undermined public confidence in the country’s judicial system,” Bhamu had argued.
Earlier on Thursday, a Harare Magistrates Court granted incarcerated CCC Members of Parliament Sikhala and Godfrey Sithole access to their rights that were restricted since their arrest on 14 June.
Harare Magistrates Court acceded to an application made by the legislators’ lawyers raising complaints against the conduct of the Zimbabwe Prison and Correctional Services.
The State did not oppose the application.
Sikhala’s lawyer Freddy Masarirevu, said the court had ordered the prisons services to allow relatives and attorneys to visit him at Chikurubi Prison.
The court also ordered that the MPs be accorded legal and medical practitioners of choice at their own cost, visits from spouses, friends and other persons of choice and delivery of food and other provisions, toiletries and reading and writing materials from friends and relatives.
Sikhala’s wife was over the weekend denied access to bring her husband a cake for his 50th birthday.
