The recent launch of Revive Maheu by Probands Pvt Ltd has irked Dairibord Zimbabwe who believe the product’s packaging is likely to deceive multitudes of its customers whom they have labored to win over in a competitive operating environment.
This
comes as Dairibord Zimbabwe has approached the High Court seeking an order to
stop Probands from retailing Revive Maheu in its current format.
“This is an application to this honourable court for an order interdicting the respondent (Probrands) from infringing its “Pfuko yeMaheu” trademarks by using packaging which is likely to deceive or cause confusion in the market. The application is made in terms of section 8 of the Trademarks Act,” Dairibord said.
The flagship subsidiary of Dairibord Holdings engaged in manufacturing and marketing of liquid milk, food and beverage products added that Probands product “infringes the applicant’s right in that it so nearly resembles that of the applicant that it is likely to and has caused confusion in the market. The bottle profile of the applicant’s product and that of the respondent are similar.”
The matter has not yet been set down for hearing.
