CHITUNGWIZA council town clerk George Makunde was suspended without benefits Monday morning as we revealed earlier.
Zim Morning Post understands that the delivery of the suspension was not without drama.
It was preceded by the physical assault on the dormitory town’s mayor Lovemore Maiko at the Head Office .
The Zim Morning Post will publish the reasons why Makunde was suspended as stated in a letter delivered to him.
Same was copied to the Local government minister July Moyo and the line ministry permanent secretary George Magosvongo.
The suspension is guided by disciplinary legislation Section 139 (3) (a) of the Urban Councils Act Chapter 29:15 .
The charge sheet read:
Acts inconsistent with your statutory obligations
“You have a statutory obligation to ensure that council business is run judiciously, properly which in the council’s view you have over the time failed to do. There is sufficient evidence in testimony to this assertion.
“Consequently, there is appearance that your non fulfillment of your duties constitutes acts of misconduct on your part which are inconsistent with the express terms and conditions of your contract of employment hence my decision to suspend you from duty.
Habitual absence from duty
“You deliberately and habitually absented yourself from duty without express authority to do so.
Gross insubordination and refusal to obey given lawful instructions
“You continue refusing to comply with lawfully given instructions given to you and in this instance, there is evidence to the effect that you failed to comply and observe set council rules, policies resolutions and extant procedures. Cited among many others.
“For example, you were instructed to avail your personal file, contract of employment to the Board of Councilors and you refused to do so.
“You were also instructed to provide contracts of employment and conditions of service for all senior managers and you refused to comply.
“You also refused and failed to comply with the instruction to strictly adhere to 30:70 salaries, service delivery expenditure ratio.
Falsification of personal and council documents
“There is good cause for Council to believe that you falsified your personal and Council documents for personal benefits.
Gross incompetence
“Council is concerned ayour perennial failure to discharge your duties diligently and effectively in line with the express of your contract of employment. Such shortcomings are regrettably detrimental to the cause of the public and quality service delivery.
Conditions of your suspension
“Your suspension is without pay and any other benefits that you are in receipt of serve for the car and the house you are residing in Council shall however, not provide you with fuel.
“You shall not be allowed to report for duty, enter any Council premises and /or purport to act on behalf of council anywhere during your suspension period.
“Any violation of these conditions shall be taken as an offence where you will further be charged and made accountable to.
“You must advice council should they be any changes on your residential address.
