THE decision made by Harare magistrate’s court of granting bail to businessman Itai Wafawarova, hours after denying him temporary release for the charge of allegedly raping his 16-year-old daughter, has left complainant’s family grumbling.
Wafawarova was on December 27 denied bail, and told to apply for bail at the High Court when he first appeared before Magistrate Victoria Mashamba on Friday morning.
He was denied bail on the grounds that he was facing a third schedule offence.
However, he was granted bail later that very day by the same court under unclear circumstances.
Complainant’s family who spoke to Zim Morning Post said they were shocked at the conduct of the Harare magistrate’s court and would seek redress through appropriate channels.
“We had left the courts since we were done for the day but we were shocked when we learnt that Itai was granted bail. We then followed up to confirm if it was true and we found out that he had indeed been released. We want to get to the bottom of this and we will exhaust every possible avenue until justice is served,” a family member who decline to be named said.
The 48-year-old Wafawarova is facing two counts of rape charges as defined in Section 65 of the Criminal law (Codification and Reform) Act.
