A FORMER Zanu PF youth league member Rodney Ndangariro Dangarembizi’s trial on Monday failed to kick-off due to the absence of his legal representative.
Dangarembizi applied for postponement of the trial because the advocate who was supposed to represent him was pre-occupied with another matter.
The accused allegedly stole 269.82 metric tonnes of fertilisers from Umbrella Holdings (Private) Limited, represented by Antony Denga and sold it to various customers, obtaining US$116 762 in the process.
It is the State’s case that sometime in June 2017, the complainant engaged the accused to be assisted in recovering his 360 metric tonnes of fertilisers from Windmill Zimbabwe (Windmill).
This was after Windmill had failed to make the payment to Umbrella Holdings, prompting Umbrella to cancel the transaction.
Accused managed to recover the said quantity of fertilisers.
The fertilisers were taken to Croplink (Private) Limited for safe keeping where it was kept at S & P Logistics Warehouse under the custody of Croplinks director, Jacques Deflin Leitao.
Dangarembizi then volunteered to sell the fertiliser on behalf of the complainant.
He collected 269.82 tonnes consisting of 29.56 metric tonnes of urea and 240.26 of compound D fertilisers, as evidenced in the document.
Accused person sold the fertilisers and made US$ 116 762 and did not hand it over to the complainant.
Umbrella Holdings suffered a prejudice of US$116 762, which was never recovered or compensated.
Magistrate Maturure postponed the case to December 17.
